Our 22C cell phone customers are provided a 14 calendar day grace period to cancel their order and return their units at their expense beginning the day they first receive their units, provided that we are informed of their intent in advance of return, and provided that customers have first obtained an Return Merchandise Authorization (RMA) from Capital Accessibility in advance of shipment. this cancellation policy applies to first-time purchasers only, and applies to one unit only unless multiple units are purchased together in order to qualify for a Family Plan service contract from T-Mobile. We charge a 15% restocking fee in all cases of return under this policy.

Units returned under the terms of this grace period policy must be returned intact, without damage, in the original container, and must include all items originally provided including battery, charger, CD ROM and printed documentation. Units must be insured against loss or damage in shipment for $500 by the customer. However, a customer notifying us of intent to return their unit within 14 calendar days will not be penalized should Capital Accessibility fail to issue an RMA within that time period.

Customers who have also contracted for service with T-Mobile are hereby advised that service contracts with T-Mobile must be canceled directly with T-Mobile during this same 14 calendar day grace period. Capital Accessibility is unable to cancel T-Mobile Service Agreements on our customer's behalf.

Once phones returned under this policy have been received by Capital Accessibility, the shipping container will be checked for inclusion of all items and for freedom of the components from damage. It is expected that this examination will ordinarily take 2-3 business days from date of receipt, but in some circumstances it could take up to a week.

Credit card refunds for telephones returned under the terms of this policy are processed within 72 hours of the aforementioned examination. Such credits will be for the amount paid for the phone less the restocking fee. If the purchase was made by check or money order, Capital Accessibility will issue and mail a refund check according to the same time frames.

In the event the phone has not been return completely or is found to have been damaged, the customer will be notified that we cannot issue a refund until the missing items are returned, or because of damage caused by the customer to the phone.

 

Limited Warranty

Capital Accessibility honors the Manufacturer's Limited Warranty on the Owasys 22C talking screenless cellular telephone handset and implements this warranty on behalf of the manufacturer, Owasys, S.L., in the United States and Canada. This warranty protects you against defects in materials manufacturing, and workmanship. Your handset is warranted for two (2) years from the date of purchase, and your battery and accessories for six (6) months from the date of purchase. Should the telephone or any of its accessories become defective during the warranty period, Capital Accessibility will repair or replace defective elements free of charge. All decisions regarding whether any particular elements are defective, and whether any elements are to be repaired or replaced, whether in whole or in part, is reserved to the sole discretion of Capital Accessibility and Owasys S.L.

This warranty is also subject to the following terms and conditions:

  1. Capital Accessibility reserves the right to demand proof of purchase.
  2. Defects or failures resulting from improper use are not covered under this warranty.
  3. Any defect or damage caused by software installation, modification, attempted repairs, or by being opened by unauthorized personnel are not covered under this warranty.
  4. Manipulating defacing, removing, or otherwise tampering with any of the affixed labels and/or seals on the product will void this warranty.
  5. Connecting unauthorized accessories will void this warranty.
  6. This warranty does not apply in case of accident, theft, acts of vandalism or natural disasters.
  7. Capital Accessibility cannot be held responsible for problems or failures connecting with service providers networks due to lack of coverage, service availability, or failures to perform on the part of the network service provider.

units returned under this warranty are returned at the customer's expense, and are to be insured for $500 in shipment. Units will only be accepted for warranty repair or replacement after a Return Merchandise Authorization (RMA) has been issued by Capital Accessibility prior to shipment by the customer. Any unit requiring warranty repair more than twice will be taken out of service and replaced with a new unit.

 

Privacy Policy

Capital Accessibility is committed to protecting the privacy of our customers, listserve subscribers web page visitors, telephone callers, and others who communicate with us. This privacy policy is set forth to provide details of our commitment.

  1. Capital Accessibility will not sell or give away any information about our customers or inquirers.
  2. Capital Accessibility will not disseminate, distribute or disclose any personal or identifying information except as required by law, (see paragraph 7), or except as required to process and fulfill orders and requests (see paragraph 8).
  3. In order to forestall breaches of customer security, Capital Accessibility maintains sensitive customer data such as Social Security numbers, TIN's, credit card numbers and bank account numbers only on secure servers using strong encryption technology, and removes this data once the transactions for which this information is required have been completed and the data is no longer required.
  4. Capital Accessibility will retain other contact information (name, postal address, phone number and e-mail address) for purposes of informing customers of new products, price changes or other developments that may be of interest to them. Any customer wishing not to receive such occasional updates will, upon request, be removed from this contact database.
  5. Capital Accessibility currently operates two listserves which individuals may join. As with customer data, Capital Accessibility will not sell (or give away) the contact information of subscribers to these lists, or to such other lists as we may establish. Capital Accessibility is not responsible for and cannot prevent the disclosure of personal or contact information by list members in the course of their postings to the list.
  6. In the maintenance of all data and information, Capital Accessibility adheres to the highest standards of file and web site security. Capital Accessibility, however, is not responsible for breaches of security resulting from unlawful activity or hacking that are beyond its control and that took place despite our high levels of vigilance.
  7. Capital Accessibility must furnish any information in its possession that may be required through lawful process by local, state or federal government agencies or authorities, including information sought by judicial subpoena. Capital Accessibility is not in a position to evaluate such requests and will not take upon itself the task of resisting such requests or litigating their validity.
  8. Capital Accessibility cannot be responsible for any use of information made by others lawfully in possession of such data through us, such as banks or other third-party credit card processors or such as cell phone service providers.
